Henry M. Davis is a welder erroneously arrested by Ferguson Police (including Kim Tihen, now a member of the Ferguson City Council) in 2009. While in custody, Henry Davis was allegedly beaten by police while handcuffed in a cell. He was bleeding too much from the police assault and had to be hospitalized. To add insult, the police then charged Davis with "destruction of property" for bleeding on their uniforms:
“On and/or about the 20th day of Sept. 20, 2009 at or near 222 S. Florissant within the corporate limits of Ferguson, Missouri, the above named defendant did then and there unlawfully commit the offense of ‘property damage’ to wit did transfer blood to the uniform”
Davis filed a civil case seeking redress that is still making its way through appeals. Despite filing this document on penalty of perjury, the police then recanted this statement and said that there was no blood during the civil case. A judge found that this perjury was too unimportant, "de minimis", to warrant prosecution. The contradictions led the prosecutor to drop the charges against Davis filed by police.
